  • Design

    Design refers to a product’s shape and configuration which includes packaging, ornament or pattern. Novelty is the key consideration and it refers to the feature of the product which has not been published or disclosed in Hong Kong or elsewhere before the application.

    Owner’s Right

    If someone copies or imitates a product that has already been registered, the design right owner can take legal action to stop further infringement and claim for damages from the infringer.

    How to Show Your Right of a Registered Design?

    In order to demonstrate publicly that the product design has been registered, the owner should print the design registration number issued by the intellectual property authority on the product, its packaging, advertisements and product catalogue to indicate clearly that the product design has been duly registered.

    Example:  Hong Kong Design Reg. No. 12345

    What is Infringement?

    Infringement may have occurred if the owner finds the design of someone’s product substantially similar to his registered design or a third party copies or imitates the registered design without the consent of the owner.
