  • Patent

    Patents exist for the protection of new technologies, inventions and creations, thus safeguarding inventors’ and owners’ rights of manufacture and sale of the technologies, inventions and creations. To satisfy the basic requirements of patent application, the technology and inventive creation must meet the following criteria:

    1. It must be capable of industrial application;
    2. It must be new and never been made public;
    3. It must involve an inventive step.

    Owner’s Right

    A patent owner has the right to manufacture and sell the new technology and creation. The owner can also prohibit use of the technology and the inventive creation by any third party without owner’s permission.

    How to Show Your Right of a Patent?

    A patent owner can print the patent registration number issued by the intellectual property authority on the product, its packaging, advertisement and in the product catalogue.
    Example:  Hong Kong Short Term Patent No. 1234567

    If the application is still pending for approval, the patent owner can print “Patent Pending” on the product, its packaging, advertisement and in the product catalogue.

    What is Infringement?

    Infringement may have occurred if someone manufactures and sells the patented technology or invention without the permission of the owner. Infringement of patent rights is a civil offence in Hong Kong.
