Policy Consultation on the Implementation Code of Labour Contract Law

     

The State Council’s Office of Legal Affairs has just initiated the public consultation on the draft Implementation Code of Labour Contract Law. The Draft Implementation Code provides detailed interpretation on certain provisions in the Law, including different conditions under which an open-end contract can be terminated, as well as methods of calculation in determining economic compensation. The aforesaid Draft can be viewed at the following link:

Members are invited to fill out the attached questionnaire on the Draft and return it to the secretariat before 16 May (Friday). The secretariat will compile the comments in a submission to the State Council.

《中華人民共和國勞動合同法實施條例》(草案)徵詢意見

 

一、                 勞動合同的訂立和履行

 

第六條  勞動者自用工之日起1個月內拒不簽訂書面勞動合同的,用人單位可以提前3日書面通知勞動者終止勞動關係,無需向勞動者支付經濟補償。

 

第七條           用人單位自用工之日起超過1個月不滿1年未與勞動者訂立書面勞動合同的,應當依照勞動合同法第八十二條第一款關於用人單位不與勞動者訂立書面勞動合同應當向勞動者每月支付2倍工資的規定執行,並與勞動者補訂書面勞動合同。勞動者拒不補訂書面勞動合同的,用人單位可以終止勞動關係並依照勞動合同法第四十七條規定的經濟補償標準向勞動者支付經濟補償。

第十三條  勞動合同解除或者期滿,用人單位未依法支付經濟補償,或者未辦理解除、終止勞動合同的手續並辦理工作交接手續,仍繼續留用該勞動者的,視為續訂固定期限勞動合同。符合勞動合同法第十四條關於訂立無固定期限勞動合同情形的,應當訂立無固定期限勞動合同。

第十九條  用人單位一次性或者12個月內累計為1名勞動者支出超過本單位上年度平均工資30%的費用進行培訓的,視為提供了勞動合同法第二十二條第一款規定的專項培訓費用。勞動合同法第二十二條第二款規定的培訓費用包括有支付憑證的培訓費用、培訓期間的差旅費以及因培訓產生的其他直接費用。

二、 勞動合同的解除和終止

第三十三條  勞動者達到法定退休年齡時尚不能依法享受基本養老保險待遇的,用人單位可以終止勞動合同;但是,應當依照勞動合同法第四十七條關於經濟補償標準的規定向勞動者支付經濟補償。

第三十六條 用人單位與勞動者約定了服務期,依照勞動合同法第三十八條關於因用人單位違法,勞動者可以解除勞動合同的規定解除勞動合同的,不屬於違反服務期的約定,用人單位不得要求勞動者支付違約金。

     在五種情形下(詳見草案),用人單位與勞動者解除約定了服務期的勞動合同的,勞動者應當按照約定向用人單位支付違約金:
